Terms of Service

These Terms of Service ("Terms") govern your access to and use of the platform, website, and services (collectively, the "Service") provided by Trainlike Studios Inc. ("Trainlike Studios," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under the laws of British Columbia, Canada, to use the Service.

2. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information,
• Maintain the confidentiality of your login credentials,
• Be responsible for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Service Description

Trainlike Studios provides a fitness application and related services that allow users to:

• Log and track workouts and personal records,
• Create and organize workout routines and programs, and
• Receive automated insights, grades, and training analysis based on their own logged data.

Trainlike Studios is not responsible for the accuracy, safety, or effectiveness of any workout or training content created or distributed through the Service.

4. User Content

You retain ownership of all workout plans, routines, and other content ("User Content") you create or upload. By using the Service, you grant Trainlike Studios a non-exclusive, worldwide, royalty-free license to host, display, and process your User Content as necessary to operate the Service.

You represent and warrant that:

• You have the rights to all User Content you create or upload;
• Your content does not infringe any third-party rights; and
• Your content complies with all applicable laws and regulations.

5. Creator Tools

The Service includes free web tools that generate images ("stickers" and "cards") from routines, lifts and muscle maps you enter. These tools run in your browser; we do not receive or store what you build, including any photo you add.

You may not extract, redistribute or resell the exercise demonstration media or muscle figures on their own, or use them to build a competing library. Anything you type or add is User Content: you are responsible for it, including having consent to use another person's name or likeness. The tools are provided as is and may change or be withdrawn at any time.

6. Prohibited Conduct

You agree not to:

• Use the Service for unlawful or fraudulent purposes;
• Upload or distribute harmful, defamatory, or infringing material;
• Reverse engineer, copy, or resell the Service;
• Use the Service to provide medical or therapeutic advice; or
• Interfere with or disrupt the Service or its infrastructure.

7. Subscription and Payments

• Access to certain features may require payment of a subscription fee.
• All fees are stated in Canadian dollars (CAD) unless otherwise specified.
• Payments are processed by Apple through App Store in-app purchases and are subject to Apple's terms.
• Fees are non-refundable except where required by law.
• Trainlike Studios reserves the right to modify pricing or plans with reasonable notice.

8. Intellectual Property

All intellectual property rights in the Service, including software, design, trademarks, and logos, are owned by Trainlike Studios Inc. or its licensors.

Nothing in these Terms grants you ownership or the right to use our branding except as necessary to use the Service in accordance with these Terms.

Exercise demonstration media is licensed from a third party and may be used only within images produced by the Service.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis.

Trainlike Studios makes no warranties, express or implied, including but not limited to:

• Merchantability, fitness for a particular purpose, or non-infringement,
• The accuracy or reliability of generated content or exported materials.

Trainlike Studios does not provide medical, fitness, or health advice. Users are solely responsible for ensuring the safety and appropriateness of any workout or training plan shared through the Service.

10. Limitation of Liability

To the fullest extent permitted by law, Trainlike Studios Inc. shall not be liable for any:

• Indirect, incidental, or consequential damages,
• Loss of profits, data, or business opportunities,
• Damages arising from third-party conduct or content.

Our total liability for any claim related to the Service shall not exceed the greater of (a) the amount you paid to Trainlike Studios in the six months preceding the event or (b) CAD $100.

Some jurisdictions (including British Columbia) do not allow certain limitations of liability, so some of the above may not apply to you.

11. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if:

• You violate these Terms,
• We discontinue the Service, or
• Required by law or regulation.

Upon termination, your right to use the Service will immediately end. Certain provisions (e.g., intellectual property, limitation of liability) will survive termination.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose information.

13. Changes to These Terms

We may update these Terms from time to time. Any material changes will be communicated via email or in-app notice.

Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

Any disputes shall be resolved in the courts of Vancouver, British Columbia, unless otherwise required by law.
